The question in this case is whether the Governor has the right to make an appointment to fill a vacancy in the office of clerk to the County Commissioners of Allegany County.

On July 27th, 1939, after Thomas P. Richards, the incumbent, had been ordered removed from the office by the Board of County Commissioners, William H. Buchholtz, the appellant, attempted to qualify for the office in Cumberland upon a commission from Governor Herbert R. O’Conor and a bond in the amount of $5,000.
