While on probation following his conviction of rape in the third degree, defendant was charged in an indictment with failure to register under the Sex Offender Registration Act and three counts of possessing a sexual performance by a child. Defendant pleaded guilty to failure to register under the Sex Offender Registration Act and one count of possessing a sexual performance by a child in full satisfaction of the indictment and waived his right to appeal.
