The City of Philadelphia (“City”) appeals an en banc Commonwealth Court order which affirmed the grant of a preliminary injunction by the Court of Common Pleas of Philadelphia County. District Council 33 of the American Federation of State, County and Municipal Employees, AFL-CIO (“Union”) had sought the injunction to prevent the implementation of City Ordinance 1107 which enacted Municipal Retirement System Benefit Plan 1987 (“Plan 87”).
