GADOLA, District Judge.

This suit involves a royalty interest in tracts of land in the Columbus III oil. field in St. Clair County, Michigan. The field is leased to and operated by defendants Sun Exploration Company and Sun Operating Limited Partnership. Plaintiffs Edgar J. and Theresita Dietrich filed their five-count amended complaint April 11, 1988. Count II of plaintiffs amended complaint has been dismissed.
