Plaintiff instituted an action for divorce against her then husband, Kilgallon, in the Superior Court of Illinois, a court of unquestioned jurisdiction. Kilgallon appeared personally and on January 17,1935, plaintiff obtained a decree. The judgment recites these facts and makes a finding of jurisdiction of the parties, the subject matter and of the residence of plaintiff in Illinois. The defendants herein seek to attack collaterally the validity of the Illinois decree and to examine Kilgallon as a witness before trial to that end, in this action, in which plaintiff seeks a declaratory…
