This appeal is from a judgment for the defendant, entered upon motion for a directed verdict, in an action by a tenant against her landlord for injuries sustained on July 5, 1953, in a fall from the second story porch of her apartment.

The appellant, a young woman about twenty-six years old, originally occupied a first floor apartment in the premises, 2226 Eutaw Place, with her husband and two small children, but the husband left and in September, 1952, she moved into a furnished, second floor, rear apartment, which was smaller and less expensive.
