MEMORANDUM OPINION

This matter comes before the court on appeal from the United States Bankruptcy Court for the Western District of Virginia. Double O Coal Corporation (“Double O”) is a debtor in bankruptcy. Glenn R. Tankers-ley (“Tankersley”) serves as Chapter 7 trustee for the Double O estate. Tankers-ley brought an adversary proceeding against Ambrose Branch Coal Co., Inc. (“Ambrose”) and others on August 9, 1988. Ambrose now appeals to this court, under 28 U.S.C. §§ 158(a) and 1334(a), from the denial of its motion to dismiss the complaint as…
