This is an appeal on questions of law from a judgment for the defendant rendered by the Court of Common Pleas of Cuyahoga county.

The plaintiffs alleged in their petition that the defendant was a banking corporation under the laws of Ohio and that plaintiffs made an “arrangement” with defendant in 1922, whereby plaintiffs made deposits aggregating $2,775.09 with defendant during succeeding years, for which amount and their share of the earnings, determined by an accounting of the defendant corporation, they prayed judgment.
