George Dewey Barnes, who established the trust in question, hereinafter referred to as the “settlor/’ died November 16, 1933. Carrie W. Barnes is his mother. The trust indenture was executed March 29, 1930. The petition of the corporate trustee prays for orders of the court as follows: “(1) Construing subdivision (a) of paragraph 5 [of article 8] of the trust indenture [printed in the margin] ; 1 (2) fixing the status of the excess payments over the face value of the policies amounting to $6,885.31 received by said trustees; (3) in the event that the court finds that these excess payments…
