Appeal from Circuit Court, Lyman County; Hon, Frank: B. Smith, Judge. Action by Ben Bekker against the White River Valley Railway Company. From the judgment for plaintiff, and an order denying its motion for a new trial, defendant appeals.

The complaint in this action, all the allegations of which are denied by the answer, except defendant’s corporate existence, -is as follows: " (I) That the defendant was, at all times hereinafter mentioned, and now is, a domestic corporation organized and existing under the laws of South Dakota, and that at the times hereinafter mentioned defendant was, and still is, operating a railroad running through Lyman county, in said state; (2) that on the 16th day of July, 1908, by reason of defendant’s neglect to construct a fence along its railroad track and maintain guards thereon, where the right…
