This is an action by the beneficiary named in an accident insurance policy issued by the defendant to recover for the death of the person whose life was insured by such policy. The case has been twice tried to a jury. On each trial a verdict was returned for the plaintiff. The judgment rendered pursuant to the verdict returned on the first trial was reversed by this court and the. case remanded for a new trial. Jacobson v. Mutual Ben. Health & Acci. Asso. 69 N.
