This was a bill filed October 18, 1922, by the appellees Otto Bilhuber and Emilie Bilhuber in which it is charged that in the year 1907 the complainant, Frank Wawak, Sr., and one Bose, organized the BilhuberBose Company, with a capital stock of $25,000, and that Frank Wawak, Sr., was made president and the complainant Otto Bilhuber, secretary; that during the year 1917 the said Wawaks, Senior and Junior, had acquired control of the stock of said corporation, and that for the purpose of minimizing the income payable to the United States Government and for the purpose of creating a fictitious…
