Harry Pyle was convicted of murder in the first de*773gree for alleged participation in the killing of August Reiter on the night of December 23,1934.

The murdered man was one of two bachelor brothers who resided on a farm in Stafford county about a mile and a half southwest of a placed called Willinger filling station and about five and a half miles northeast of the city of Hudson.
