The plaintiff, Frank VanWulfen, owns property on the shore of an inland lake located in Montmorency County, Michigan. The water level of the lake can be adjusted by changing the flow of water through a dam at the lake’s East end. The water level is regulated by the" county drain commissioner in accordance with procedures set forth in Michigan’s Inland Lake Levels Act, Mich. Comp. Laws § 324.30701 et seq.
