In this canse, Jim Clark, who was plaintiff in the lower court, appeals in error from a jury verdict and judgment based thereon in favor of defendant, James Preston Allison. The parties will be referred to in this opinion, as in the lower court, as plaintiff and defendant, or called by their respective names.
