Appeal from a judgment of the superior court for Yakima county, Preble, J., entered August 19, 1914, upon sustaining a demurrer to the complaint, dismissing an action to forfeit the franchise of a corporation and wind up its affairs.

This action was instituted on the relation of the insurance commissioner of the state of Washington against the Universal Service Agency, a corporation, organized under the laws of this state, to forfeit its corporate franchise and wind up its affairs. A demurrer was interposed and sustained to the complaint, and from an adverse judgment rendered thereon, the relator appeals. The grievance specially complained of in the complaint is that the respondent corporation has been, and is now, doing an insurance business without complying with the statutes regulating the doing of such business.
