Civil action to recover damages for alleged negligent killing of plaintiff's intestate. The facts in evidence tended to show that on the morning of 11 January, 1921, about 10 o'clock, plaintiff's intestate, while walking along defendant's railroad track, several hundred feet beyond a crossing, was run over and killed by a train of defendant company, operated at the time by Vernon Rogers, a codefendant.
