MEMORANDUM OF OPINION

This matter is before the Court on the complaint of D.H. Overmyer Telecasting Co., Inc. (“Telecasting”) and The First National Bank of Boston (“FNBB”), alleging that Lake Erie Communications, Inc. (“Lake Erie”) violated the automatic stay provisions of the Bankruptcy Code, in particular Section 362(a)(3), 1 and the motion of Lake Erie to dismiss or, alternatively, for summary judgment.
