Plaintiff-Appellant Gregory Goodrich (“Goodrich”) is an employee of DefendantAppellee The Long Island Rail Road Company (“LIRR”). On March 12, 2010, he brought suit under the Federal Employers’ Liability Act (“FELA”), 45 U.S.C. § 51 et seq., against his employer, the LIRR, and two individual defendants, alleging claims of negligent infliction of emotional distress (“NIED”) and intentional infliction of emotional distress (“IIED”) against each of the three defendants.
