This is an appeal by defendants doing business under the name of Basich Bros., a partnership, from orders of the trial court denying its motion for judgment notwithstanding the verdict and for a new trial, and from the judgment entered by the court pursuant to the verdict of the jury.

The plaintiffs Don Mullanix and Julian C. Berry, by their joint complaint, alleged that about 3:30 o’clock a. m. on October, 26, 1942, a truck, owned by the defendant Ford and under hire to defendant Basich Bros,, while being driven by one Zumwalt, who was then in the employ of both Ford and Basich Bros., ran off…
