Appeal from Sioux District Court. — William Hutchinson, Judge. Action at law to recover upon a life insurance benefit certificate. There was a trial to the court without a jury. Judgment for the plaintiff, and defendant appeals.—

The defendant is a fraternal society, which provides its members with- life benefit certificates. On July lá, 1905, the society admitted to its membership *653one William A. Haines, and issued to him a benefit certificate,, payable at his death to his mother, Mary Haines, plaintiff in this case. At the date of this transaction, Haines was about 19 years of age, living with his parents, and working with his father at the carpenter’s trade.
