In this case, an action was brought to recover upon a life insurance policy.

In plaintiff’s complaint, filed October 7, 1937, it was alleged that, February 4, 1929, defendant insurance company issued a policy upon the life of Charles A. Navone, now deceased, in the amount of five thousand dollars, payable to his wife, Alta Mae Navone, now Alta Mae Howard, as beneficiary; that Charles A. Navone was a business man in the city of Seattle, living with his wife and family; that, just prior to that time, the insured had suffered a nervous breakdown, and thereafter was worried, despondent, and made…
