Plaintiff brings this action under the Federal Employer’s Liability Act (“FELA”), 45 U.S.C. §§ 51 et seq., to recover for injuries suffered while working for Defendant Norfolk Southern. Before me is Defendant’s Motion for Partial Summary Judgment as to Count II in Plaintiffs Amended Complaint, and Plaintiffs Motion for Leave to File a Second Amended Complaint.
