The appellant, Thomas S. Culver, a captain in the Judge Advocate General’s Corps of the United States Air Force stationed at the Royal Air Force (RAF) Base in Lakenheath, Suffolk, England, in July, 1971, was tried and convicted by general court-martial on charges of conduct unbecoming an officer and a gentleman, in violation of Article 133 of the Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 933 (1970),1 in that on May 24, 1971, he solicited other military personnel to violate a general Air Force Regulation, AFR 35-15,13e(3)(b)(8),2 prohibiting Air…
