TYSON, Judge.

Wylie William Elder ("defendant") appeals from a judgment entered 15 January 2004 after a jury found him to be guilty of operating a motor vehicle to elude arrest. We find no error.

I. Background

The State's evidence tended to show on 2 March 2003 Cabarrus County Sheriff's Deputy Steven Derrick Wagoner ("Deputy Wagoner") was dispatched to an address on "A" Street where a suspect was fighting with fire and emergency medical services personnel and family members.
