This is a consolidated case in which The Boeing Company seeks review of that portion of the superior court order denying its summary judgment motion for dismissal. Boeing claims that direct estoppel precludes the state court action.

The two consolidated actions arose out of the November 19, 1977 crash upon landing at a Portuguese airport of a Boeing 727 airplane operated by Transportes Aereos Portugueses (TAP) during an intra-Portugal flight in which 132 people aboard the plane were killed and the remaining 32 people were injured.
