Plaintiff as executor of the deceased, Saul S. Myers, brings this action to recover the face value of two policies of life insurance amounting to $25,000 each. The complaint consists of four causes of action, two causes of action being devoted to each of the policies. A motion for summary judgment was directed against the second cause of action on each policy. Special Term granted plaintiff’s motion on the second causes of action and severed these from the complaint.
