This controversy, submitted by the parties upon an agreed statement of facts, involves the interpretation of section 352 of the Banking Law, frequently referred to as the Small Loans Act.

*525On December 21, 1939, the defendants borrowed $120 from the plaintiff, a duly licensed lender, on their note payable in twenty equal monthly installments with interest at the rate of two and one-half per cent on any unpaid principal balance.
