The p]aintiff> Heazle Benjamin Majors, bad been a rajiroad conductor employed by the defendant, Guy A. Thompson, Trustee of the New Orleans, Texas and Mexico Railway Company. In like situation was the plaintiff, Clark Payton Walk-er_ They were members of the conductors’ union known as the Order of Railway Conductors. The Union and the Trustee had made an agreement relating to employment by the Trustee of railway conductors.
