This action is based upon §§ 5197 and 5198 of the Revised Statutes of the United States, and is brought by the respondent against the appellant, a national hank organized and incorporated under the laws of congress, to recover double the amount of interest paid by respondent to appellant in excess of *95seven per cent., within two years prior to the commencement of the action.
