The defendant-appellant Larry Rivera appeals from the judgment of the circuit court of the first circuit, the Honorable Derrick H.M. Chan presiding, filed on October 8, 2003, convicting him of and sentencing him for the following offenses: (1) promoting a dangerous drug in the third degree, in violation of Hawaii Revised Statute (HRS) § 712-1243 (1993 & Supp.2003);1 (2) unlawful use of drug paraphernalia, in violation of HRS § 329-43.5(a) (1993);2 and (3) promoting a detrimental drug in the third degree, in violation of HRS § 712-1249 (1993).3 On appeal,…
