MEMORANDUM OPINION AND ORDER
BABCOCK, District Judge.
Jonathan F. Clark (Clark) moves alternatively for full or partial summary judgment on the amended order citing him to show cause under C.R.C.P. ■ 106(a)(5) why he should not be bound by the judgment entered against defendants. The Resolution Trust Corporation (RTC), as conservator for First Federal Savings Bank of East Alton, Illinois (First Federal) filed a cross motion for summary judgment.
