HILLMAN, District Judge.
Before the Court is defendant’s motion for summary judgment and plaintiffs’ cross-motion for partial summary judgment. For reasons explained below, defendant’s motion for summary judgment will be granted in part and denied in part, and plaintiffs cross-motion for summary judgment will be granted in part and denied in part. Dr. Fisher will be allowed to testify as plaintiffs expert, but cannot rely on the U.S. Coast Guard Navigation and Vessel Inspection Circular No. 4-89 in his opinion.
