Action of interpleader to determine the rights of the respective defendants in and to a sum of money in the hands of the plaintiff, brought to and tried by the Court of Common Pleas in New Haven County, Simpson, J.; facts found and judgment rendered awarding the money to the defendant Taniska, from which the other defendant, Majkowski, appealed.

May 17th, 1910, Wladyslawa Taniska brought an action for a breach of promise of marriage against Baleslaw Majkowski, in which the writ directed the attachment of his body. On the same day Taniska swore out a complaint in bastardy before Frederick M. McCarthy, a justice of the peace for New Haven county, in which she alleged that she was a single woman, and that she was pregnant with a child begotten by Majkowski.
