This action was instituted by the Boston and Colorado Smelting Company, against Hugh McDougall, Hugh R. McClelland and Thomas Keely.
The plaintiff corporation was dissolved prior to the trial and the statutory trustees substituted.
The complaint alleges that prior to the year 1898, the plaintiff was the owner of a smelter site, upon which it had formerly operated a smelter, and upon 'which there was a large amount of slag containing metal values; that the plaintiff proposed to McDougall and Mc-Clelland to sell them the site with the slag for the price of $5,000, of which $2,000 was to be paid…
