This case comes on upon defendants’ (1) motion to dismiss, (2) motion for a more definite statement and (3) motion to strike.

Claimant’s cause of action is set forth in his claim filed in the Probate Court of Sangamon County, which is accompanied by his affidavit supporting said claim and filed in that court. The claim is transferred to this court upon petition of the defendant estate and its administrators upon the ground that the claim is based upon the Fair Labor Standards Act of 1938, as amended, 29 U.S.C.A. § 201 et seq., and exceeds the sum of $3000.
