This matter comes before this court on plaintiff’s, Elise Brown, motion for partial summary judgement, and defendants’ Craig *434Rosenberger and Philadelphia Coca-Cola Bottling Company, answer to plaintiff’s motion.

Briefly, the underlying facts and procedural history are as follows:
