This is an appeal by the defendants from a final decree entered in the Superior Court, after rescript *460remanding the case for the purpose, among other things, of assessing such damages as the plaintiff might show that he had sustained. When the case was here before (see 309 Mass. 496, 501), the evidence was not reported, but there was a report of findings by the trial judge.
