GREEN, Chief Justice.
Curtis B. Dyer, appellant, was plaintiff in a suit on a promissory note and defendant in a suit for damages based on alleged fraud and breach of contract arising out of the same transaction. Appellees R. E. Cald-cleugh, Jr., Jack Powers and Maxine Gallagher, individually and as members of a partnership of Caldcleugh & Powers, and appellee William H. Cousins were defendants in the suit on the note, and, except for Cousins, were plaintiffs in the suit for damages. The two cases were consolidated and tried by the court without a jury.
