FERREN, Associate Judge:

On May 17, 1991, respondent Richard M. Hirschfeld was convicted in the United States District Court for the Eastern District of Virginia on two counts of conspiracy to defraud the United States Internal Revenue Service, 18 U.S.C. § 371 (1988), and one count of aiding the preparation of a false tax return, 26 U.S.C. § 7206(2) (1988). Respondent appealed to the United States Court of Appeals for the Fourth Circuit, which affirmed the convictions on May 7, 1992. See United States v.
