This action (contract or tort) was originally brought against the defendant Jacobson (hereinafter called Jacobson) and Roux Laboratories, Inc. (hereinafter called Roux), to recover damages for a severe skin infection alleged to have been caused to the plaintiff by the use of hair dye made by Roux, which the plaintiff purchased from Jacobson in April, 1949. The action was dismissed as against Roux after hearing on an answer in abatement. Jacobson’s bill of exceptions presents only an exception to the trial judge’s denial of Jacobson’s motion for a directed verdict. There was a verdict for the…
