Lew Derrey appeals the summary dismissal of his action against Toppenish School District 202 for breach of contract and negligent misrepresentation. The Superior Court based its order on former RCW 28A.88.010, which required a person appealing a decision of any school official or board to file the appeal within 30 days of the decision.
