This was an action to recover damages for personal injuries alleged to have been caused by the negligence of defendant. A *207verdict was directed for defendant in the court below, and plaintiff appealed from an order denying a new trial.
The facts are as follows: One John Wunder had entered into a contract with the owner, and was engaged in the construction of a building in the city of Minneapolis.
