STATEMENT OF THE CASE

Appellant, Michael L. Pennington, was tried by jury for the crime of First Degree Murder (malice aforethought) in violation of 21 O.S.1991, § 701.7, in Case No. CRF-91-386, in the District Court of Comanche County before the Honorable Peter Clinton Moore.
