I. INTRODUCTION
This matter comes before the Court on a motion for summary judgment (Dkt.# 29) filed by plaintiffs Center for Biological Diversity, et al. (collectively, “Plaintiffs”) and a cross motion for summary judgment (Dkt.# 41) filed by defendants Robert Lohn, et al. (collectively “Defendants” or “NMFS”).
