SWAN, Circuit Judge.

Before daylight on March 8, 1928, a collision occurred in the East River between the motor vessel Boston Soeony, owned by Standard Transportation Company, and a car float in tow of the tug P. R. R. No. 11, owned by the Pennsylvania Railroad Company. Each owner filed a libel against the vessel of the-other. The eases were tried together, and resulted in a finding that the Pennsylvania’s-tug was solely at fault. Accordingly, a final-decree of dismissal was entered in the suit brought by the Pennsylvania Railroad Company, and -an interlocutory decree for damages was awarded…
