On March 9, 1910, Mrs. Margaret Irvine was the owner of a store and office building situated at the northwest corner of Broadway and Third streets in the city of Los Angeles. On that day she executed a lease of the corner store and basement in said building to the plaintiff for the term of five years commencing on the first day of January, 1911, at a monthly rental of one thousand two hundred and fifty dollars, payable in advance on the first day of each month.
