On the 10th of August, 1877, Samuel Warner, the appellee, brought an action on the case in the Cook circuit court, against the Chicago, Burlington and Quincy Railroad Company, the appellant, to recover damages for personal injuries received by him while in the employment of the company, and which are claimed to have been occasioned through its negligence. There was a trial on the merits in the circuit court, resulting in a verdict and judgment in favor of appellee, and against the appellant, for $5000.
