This is an appeal from a decision of the Commissioner of Patents in a trade-mark registration opposition proceeding.
On September 20, 1927, appellee James McCreery & Co., filed an application in the United States Patent Office for registration, under the Trade-Mark Registration Act of February 20, 1905 (15 USCA §§ 81-109), of the words “Foot Preserver” for use as a trade-mark on “boots and shoes of leather, canvas or fabric, or combinations thereof.”
