The following among other facts were found by the referee: Eor more than six months prior to April 30, 1875, the New Orleans, St. Louis and Chicago Railroad Company had had a deposit account with the defendant, the National, Park Bank. During all that time John M. C. Rodney was the assistant treasurer of the railroad company, in the city of New York. As such he was the principal officer of the company in that city, and either personally or through his assistants made all the company’s deposits in the bank which were made therein, and together with the president of the company he signed all…
